According to the law a receiver "placed in the custodial responsibility for the property of others including tangible and intangible assets and rights." A receivership is used to denote a situation in which an institution or enterprise is being held by a receiver.
The receiver ensures rents are collected and makes the necessary decisions to position the asset for sale. They are an employee of court, trust, or independent and must answer to a court and or all parties of the lawsuit. Receivership appointments are subject to a final ruling from a court of law where the Plaintiff or defendant in a foreclosure usually makes a recommendation.
